- 1.1King Furniture Australia Pty Ltd (ACN 002 757 333) (“King Living”, “us”, “we” or “our”) recognises the importance of your privacy and takes care to protect your information.
- 1.2Where we collect personal information and credit-related information from you or about you, we comply with the Australian Privacy Principles, the Credit Reporting Regime and the Credit Reporting Privacy Code as contained in the Privacy Act 1988 (Cth) (Privacy Act).
- 1.3By visiting or using our website at www.kingliving.com.au (Website), contacting us or otherwise providing us with information (including, but not limited to, in person, in hard copy or online) you acknowledge that you understand and agree to the collection, storage, usage and disclosure of your information by us in the manner described in this privacy policy.
- 1.4Please note, to the extent our Website contains links to other websites which are provided for your convenience, we are only responsible for the privacy practices and security of our Website. We recommend that you check the privacy and security policies and procedures of each and every other website or application that you visit or use.
2Purpose for collecting personal information

2.1King Living primarily collects, holds, uses and discloses your personal information to provide our goods and services to you or your organisation or for our business purposes including, for example:
- (a) to provide the best quality products and services to you;
- (b) to promote our products and services;
- (c) to undertake any warranty claims relating to our products;
- (d) to communicate with you;
- (e) to generally improve our business;
- (f) for record keeping purposes;
- (g) to improve the quality of our service;
- (h) for market research;
- (i) to track activity on our Website;
- (j) to provide you with information about our business and services, including marketing or promotional material; and
- (k) to conduct our business and provide customer support.
3Collection of personal information
- 3.1In order to provide you with products and services, we collect personal information about you including from our Website, telephone conversations, e-mails and written and verbal communications.
- 3.2We usually collect personal information directly from you. You may provide those details when you make an enquiry with us by phone or email, in person, when you complete a form on the Website, when you interact with our social media pages or when you engage with us to provide you with our services. We may collect information when you contact us by any means.

3.3Some of the information we collect is “Personally Identifiable Information” which relates to you personally (“Personal Information”). Personal Information we collect can include, for example, your:
- (a) name;
- (b) contact details (such as telephone number and email address);
- (c) residential address, city, state, postcode, area code;

- (e) age.
- 3.4We may collect sensitive information from you or about you where there is a legal requirement to do so, or where we are otherwise permitted by law. In all other situations, we will specifically seek your consent.
- 3.5We may also supplement the information that you provide with other information that we obtain from our dealings with you or which we receive from other organisations.
4Disclosure of personal information
- 4.1In order to provide our services to you, we may need to appoint other organisations to carry out some activities on our behalf.
- 4.2All third parties are given access to the information they need to perform their function but cannot use that information for other purposes.

- (a) other organisations that we have affiliations with;
- (b) promoters or sponsors of any competition conducted or promoted by us;
- (c) specific third parties that you have authorised to receive information held by us;
- (d) other third parties where necessary or desirable to provide you with our services;
- (e) our employees, related bodies corporate, contractors or external service providers for the operation of our website or business, fulfilling requests or responding to enquiries from you or providing services to you including, without limitation, web hosting providers, IT systems administrators, mailing houses, data entry service providers, electronic network administrators and professional advisors and consultants;
- (f) any relevant authority or enforcement body where we reasonably believe that such disclosure is necessary to bring legal action against anyone who has breached our terms and conditions or have engaged in any unlawful activity;
- (g) such entities that we propose to merge with or be acquired by; and
- (h) any other person where otherwise required or permitted to by any law, including under the Privacy Act.
- 4.4Sensitive information will only be used and disclosed for the purpose for which it was collected by us or for a directly related secondary purpose.
5Special conditions for collection and use of personal information for delivery arrangements
- 5.1The following terms apply specifically where you place an order with us. In providing any of the personal information of a third person to us in accordance with this section, you confirm and acknowledge that you have received the consent of each person for whom you have provided details and that such person consents to being contacted by us for the purposes listed in this section.

5.2When you place an order with us, you will provide the full name and contact details of the persons you nominate to have “Full Access” to your order, these are:
- (a) the “Primary Contact” for the order;
- (b) the “Secondary Contact” for the order, who we will contact if your Primary Contact is unable to be contacted; and
- (c) any further persons who you nominate to have Full Access to your order.

5.3A person who has “Full Access” to your order is entitled to:
- (a) obtain information from us about the number, types and colours of products comprising your order, and about the price of your order;
- (b) obtain information from us regarding the date, time and location for delivery of your order; and
- (c) arrange for the date, time and/or location for delivery to be changed.
- 5.4A person who is nominated as the Secondary Contact or another person nominated by you to have Full Access may provide us with the contact details of a further person who can be contacted to confirm the date, time and location for delivery of your order, if they will be unavailable to accept delivery, and this further person will be treated as a Delivery Contact.

5.5When you place an order with us you may also provide the full name and contact details of a “Delivery Contact”. The Delivery Contact will only be contacted by us to confirm the date, time and location for delivery of your order. The Delivery Contact will not be provided with any of your Personal Information or any other information relating to your order, other than your name and order number, and cannot:
- (a) request information from us relating to your order, other than the date, time and location for delivery;
- (b) make any payments to King Living on your behalf;
- (c) change any of the order details, including the products comprising the order; or
- (d) change the date, time or location for delivery of your order.

5.6If you are a designer, you may nominate either:
- (a) the recipient of the order;
- (b) a Secondary Contact; or
- (c) further persons nominated by you, as a Delivery Contact and we will only contact them to confirm the date, time and location for delivery.
- (i) able to change the date, time and/or address for delivery, unless you first provide us with your consent;
- (ii) able to change any other details of the order;
- (iii) provided with any of your Personal Information; and
- (iv) provided with any information about the order, such as the price or products, apart from the date, time and address for delivery.
- 5.7If you are making your order through a corporate entity, we will obtain the details of your authorised officer to be your Primary Contact when you place your order.
- 5.8For the purposes of this section of the Privacy Policy, only you or the person who has Full Access can update their own phone number. If the change is requested over the telephone, we have full discretion whether we will update the requested change.
6Collection and use of credit card information
- 6.1King Living does not collect any financial information. Please note that where you apply for financing of your King Living products, you will be directed to a third-party provider who will manage your financial information.
- 6.2King Living takes no responsibility for your disclosure of financial information or management of such financial information.
- 6.3As a part of your use of a credit card to make a purchase, King Living will collect credit card information as a part of the King Living purchase process. King Living may need to provide this information to a third party in order to process your payment.
- 6.4Any third parties that are granted access to your credit card information will only be granted such access to the extent needed to perform their functions.
7Security of information
- 7.1King Living takes the security of your personal information, credit information and credit eligibility information seriously.

7.2We take a range of steps to ensure that this information is secure. These include:
- (a) ensuring that the information we collect is stored in a secure environment and protected from unauthorised access, modification or disclosure;
- (b) restricting access to your information to the employees, contractors and agents who require that information in order to provide you with our products or services;
- (c) backing up the information on a secure server; and
- (d) ensuring our staff receive regular training on privacy procedures.
8Disclosure to overseas recipients
- 8.1Information that we collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia.

8.2By accessing our website, you agree:
- (a) to and authorise us giving your personal information, in accordance with this privacy policy, to a third party who is not in Australia or a third party who may transfer and store outside Australia your personal information (Overseas Recipient);
- (b) that, while we will take reasonable steps to ensure that an Overseas Recipient does not breach the APPs, Overseas Recipients are not bound by the APPs and subclause 8.1 of the APPs does not apply to the disclosure of your personal information to an Overseas Recipient; and
- (c) that, if an Overseas Recipient handles your information in breach of the APPs, you will not be able to seek redress under the Privacy Act.
9Click stream data
- 9.1Each time you visit our Website our server collects some anonymous information, known as clickstream data, including the type of browser and system you are using, the address of the website you have come from and move to after your visit, the date and time of your visit and your server's IP address.
- 9.2King Living may collect this information for statistical purposes to find out how our Website is used and navigated, including the number of hits, the frequency and duration of visits, and most popular session times. We may use this information to evaluate and improve our Website performance.
10Cookies and web use tools
- 10.1To improve our business, King Living uses a variety of tracking technologies such as cookies to recognise you each time you visit our Website, as well as to track which pages are visited and what you look at on our Website.
- 10.2A “Cookie” is a piece of information that our web server may send to your device when you visit our Website. The Cookie is stored on your device, but does not identify you or give us any information about your device. A Cookie helps us to recognise you when you re-visit our Website and to co-ordinate your access to different pages on our Website. With most Internet browsers, you can erase Cookies from your device, block all Cookies, or receive a warning before a Cookie is stored. 11Requests for access and correction
- 11.1If you believe your information is incorrect, incomplete, not current or misleading, you can request that we update this information by contacting the Privacy Officer on the contact details provided below.
12Access to your personal information and credit information
- 12.1King Living acknowledges that you have a general right of access to Personal Information and credit card information concerning you and to have inaccurate information corrected. Please contact the Privacy Officer (using the details provided below) for these purposes and we will respond promptly to your request.
- 12.2If access is refused to your Personal Information or credit card information, we will give you a notice explaining our decision to the extent practicable.
13King Living employees, contractors and position applicants
- 13.1Additional privacy terms may apply to King Living employees, contractors, service providers and job applicants. We confirm that those further terms will be set out in any employment or service contracts.
- 13.2This Privacy Policy does not apply in relation to acts and practices of King Living which relate directly to employee records of present and former employees of King Living.
14Changes to this statement
- 14.1We reserve our right to revise this Privacy Policy from time to time. We will publish all updates to our Privacy Policy on our Website without any notice to you. All updates become effective when published on our Website.

We will endeavour to contact you within 7 days of you making your complaint acknowledging receipt of your complaint. It is our policy to investigate and resolve all complaints (where practicable) within 30 days of receiving the complaint. Where it is a legal requirement to do so, then in the event we need more time to investigate and resolve your complaint, we will notify you as to the reasons why and seek your agreement to extend this 30 day period (if you do not agree, we may then not be able to resolve your complaint).

1Introduction
This privacy policy (Policy) relates to your personal information in connection with your use of and access to the King Living website (https://www.kingliving.co.uk/) (the King Living Platform) and any services or products provided by King Living through the King Living Platform or at a King Living showroom (the King Living Platform and services together forming the King Living Services).
We are committed to protecting your information and your right to privacy. If you have any questions or concerns about our Policy, or our practices with regards to your personal information, please contact us via privacy@kingliving.co.uk.
When you use the King Living Services, you trust us with your information and we take your privacy very seriously. We seek to explain to you in the clearest way possible what information we collect, how we use it and what rights you have in relation to it. We hope you take some time to read through it carefully, as it is important. If there are any terms in this Policy that you do not agree with, please discontinue your use of the King Living Services.
2Changes to this policy or your personal information
We review this Policy regularly and it is your responsibility to check regularly and determine whether you still agree to comply with the Policy. If you do not agree to any changes to this Policy then you must immediately stop using the King Living Services. In the event we make any significant changes to this Policy we will use our reasonable endeavours to inform you of such changes in advance in writing.
It is important that the personal information we hold about you is true, complete, accurate and current. Accordingly, you must notify us of any changes to your personal information (for example, if you change your address or email address).
3About us
The King Living Services are owned and operated by King Furniture UK Limited (Company Number 13503839). Our registered office is Capital Law Limited, Capital Building, Tyndall Street, Cardiff, Wales, CF10 4AZ (trading as “King Living”) (King Living/we/us/our). King Living is the controller (also known as a data controller) of, and is responsible for, your personal information. The term “you” refers to the user wishing to access and/or use the King Living Services.
4Information we may collect about you
4.1 Personal information you disclose to us
(a) Where and how we collect personal information
We collect personal information that you voluntarily provide to us when registering to use and actually using the King Living Services, or otherwise contacting us.
If you apply or are put forward for a role with us, or work for us (either directly or indirectly) for any period of time, we also collect your personal information, which may include your contact details, financial and payment details, details of your education, qualifications and skills, your marital status, your nationality, your NI number, your job title and your CV.
More particularly, the personal information that we collect depends on the context of your interactions with us, the choices you make and the products and features you use. For example:
- We gather information directly from you face to face if you come to a King Living showroom or office and over the telephone if you ring us to make an enquiry.
- We collect personal information via the King Living Platform and other technical systems.
- We collect personal information when you use the King Living Platform to sign up to, participate in or receive a service from us, for example where you contact us, request information online, report an issue, provide feedback or enter a live chat.
- The King Living Platform also uses cookies and collects IP addresses (for more information on this, see our Cookie Policy).
- We may monitor and record communications with you (such as telephone conversations and emails). We may do this for a number of reasons, such as to check the quality of our customer service, for training purposes, to prevent fraud or to make sure we are complying with legal requirements.
- If you visit our showrooms or offices, some personal data may also be collected from monitoring devices and systems such as closed-circuit TV (CCTV).
(b) The types of personal information we may collect
When you use the King Living Services and/or when you otherwise deal with us, we may collect the following information about you (the Information):
- Identity Data — your first name, last name, gender and profile photo.
- Contact Data — the data we use to contact you including your billing address, delivery address, email address and contact number.
- Financial Data — the payment method, bank details or bank card used to process your payments.
- Transaction Data — details about transactions you have made in connection with the King Living Services, including the payments to and from you along with other details of products you have purchased from us.
- Profile Data — your username, email address and log-in data, details of any purchases or orders made by you, and your interests, preferences, feedback and survey or questionnaire responses.
- Usage Data — Information about how you use the King Living Platform, including your browsing patterns, how long you might spend on a webpage, what you look at and for, the referring page, click stream, page response times, and page interaction information.
- Marketing and Communications Data — your preferences with regards to receiving marketing from us and your other communication preferences.
- Other information relevant to services, customer surveys, questionnaires and/or offers.
4.2 Sensitive personal information
We will not usually ask you to provide sensitive personal information. We will only ask you to provide sensitive personal information if we need to for a specific reason, for example, if we believe you are having difficulty dealing with your account due to illness. If we request such information, we will explain why we are requesting it and how we will use it.
Sensitive personal information includes information relating to your ethnic origin, political opinions, religious beliefs, whether you belong to a trade union, your physical or mental health or condition, sexual life, and whether you have committed a criminal offence. We will only collect your sensitive personal information with your explicit consent.
4.3 Personal information from third parties
Occasionally we may receive information about you from other sources, which we will add to the information we already hold about you in order to help us provide, improve and personalise the King Living Services. If you apply for a job with us, we may also receive information from those who provide references relating to your prospective or actual engagement or employment.
4.4 Information automatically collected
We automatically collect certain information when you visit, use or navigate the King Living Platform. This information does not reveal your specific identity (unless your device name is the same as your name) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use the King Living Platform and other technical information. This information is primarily needed to maintain the security and operation of the King Living Platform, and for our internal analytics and reporting purposes.

5How do we use your information?
We use your information collected via the King Living Services for a variety of business purposes described below. We process your information for these purposes in reliance on our legitimate business interests (Business Purposes), in order to enter into or perform a contract with you (Contractual Reasons), with your consent (Consent), and/or for compliance with our legal obligations (Legal Reasons). We indicate the specific processing grounds we rely on next to each purpose listed below.
We may process your information for the following purposes:
- To take steps towards entering into a contract with you, to provide the King Living Services and to claim any right to be paid under our Terms and Conditions (Contractual Reasons). This includes preparing an agreement with you; managing any accounts you hold with us; contacting you for reasons related to the King Living Services; following up on enquiries and providing information you have requested; contacting your referee(s) or obtaining a reference for a job you are applying for; dealing with payment for the King Living Services; notifying you of changes to the King Living Services that may affect you; and resolving disputes or collecting overdue payments.
- To fulfil and manage any orders or issues in connection with the King Living Services (Contractual Reasons).
- To contact you regarding enquiries you have made in relation to the King Living Services.
- To facilitate a recruitment process in which you are involved.
- To follow up on enquiries and provide quotes (Business Purposes).
- To send administrative information to you for Business Purposes, Legal Reasons and/or possibly Contractual Reasons — for example, product, service and new feature information, or changes to our Terms and Conditions and/or policies.
- To send you marketing and promotional communications for Business Purposes and/or with your Consent. You can opt out of our marketing emails (see below).
- To facilitate account creation and the log-in process with your Consent, including where you link your account to a third party account such as Google or Facebook.
- To administer promotions for our Business Purposes and/or with your Consent.
- To request feedback for our Business Purposes and/or with your Consent.
- To protect the King Living Services for Business Purposes and/or Legal Reasons, including monitoring and/or preventing fraud.
- To enforce our Terms and Conditions and/or policies for Business Purposes, Legal Reasons and/or possibly Contractual Reasons.
- To respond to legal requests and prevent harm for Legal Reasons — for example, if we receive a subpoena or other legal request.
- For other Business Purposes, such as data analysis, identifying usage trends, determining the effectiveness of promotional campaigns and evaluating and improving the King Living Services, our products and services, our marketing and your experience.
6Will your information be shared with anyone?
We only share and disclose your information in the following situations:
- Contractual. We may share information with any third parties we work with to enable any orders for services, or obligations arising out of any such orders, to be fulfilled.
- Compliance with Legal Obligations. We may disclose your information where we are legally required to do so, such as in response to a court order or a subpoena (including requests from public authorities for national security or law enforcement purposes).
- Vital Interests. We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential policy violations, suspected fraud, illegal activities or threats to safety, or where necessary for evidence in litigation we are involved in.
- Third Party Service Providers. We may share your information with third party vendors, service providers, credit reference agencies, trade associations, credit card associations, contractors or agents who perform services requiring access to it (for example, third party software developers). Such third parties may only use it as we ask and in accordance with this Policy.
- Sharing with other users. Certain information will be shared with other members of your workspace or people administering your workspace — usually colleagues you work with day-to-day, or clients you have added to your workspace.
- Business Transfers. We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business.
- Third Party Advertisers. We may use third party advertising companies to serve ads when you visit the King Living Platform. See our Cookie Policy for further information.
- Business Partners. Provided you have given us Consent, we may share your information with our business partners to offer you certain products, services or promotions.
- With your Consent. We may disclose your information for any other purpose with your Consent, including with any person you have named as a contact for your account.
We may disclose aggregated, anonymous information (from which you cannot be personally identified), or insights based on it, to selected third parties, including analytics and search engine providers, to assist us in improving and optimising the King Living Services. We will not disclose any information which can identify you personally in such circumstances.
7Is your information transferred internationally?
Whenever we transfer your information internationally, we will take all reasonably practicable measures to protect it in accordance with this Policy and applicable laws. To the extent that any transfer requires approved safeguards to be in place, we will only transfer your information to countries deemed to provide an adequate level of protection for personal data, or using legally compliant transfer mechanisms.
8Third party websites
The King Living Platform may feature links to third party websites or social media channels, or contain advertisements from third parties that are not affiliated with us and which may link to other websites, online services or mobile applications. We cannot guarantee the safety and privacy of data you provide to any third parties. Any data collected by third parties is not covered by this Policy.
We are not responsible for the content or privacy and security practices and policies of any third parties, including other websites, services or applications that may be linked to or from the King Living Platform. You should review the policies of such third parties and contact them directly if you have any related questions.
9For how long do we keep your information?
We will only keep your information for as long as it is necessary for the purposes set out in this Policy, unless a longer retention period is required or permitted by law (such as tax law, accounting requirements or other legal or regulatory requirements).
When we have no ongoing Business Purpose to justify processing your information, we will either delete or anonymise it, or, if this is not possible (for example, because your information has been stored in backup archives), we will securely store your information and isolate it from any further processing until deletion is possible.
10How do we keep your information safe?
We have implemented appropriate technical and organisational security measures designed to protect the security of any information we process. For example, we store your personal data on secure servers and company data is stored on separate secure encrypted disks when not in use.
We have procedures in place to deal with any suspected data security breach. We will notify you and any applicable supervisory body of a suspected data breach where we are legally required to do so.
However, please also remember that we cannot guarantee that the Internet itself is 100% secure. Although we will use our reasonable endeavours to protect your information, we cannot guarantee the security or integrity of personal information that is transferred from you or to you via the Internet. Transmission of personal information to and from the King Living Platform is therefore at your own risk. You should only access our services within a secure environment.
11Do we collect information from minors?
We do not knowingly solicit data from or market to children under 16 years of age. By using the King Living Services, you represent that you are at least 16 years of age. If we learn that information from users less than 16 years of age has been collected, we will deactivate the relevant account and take reasonable measures to promptly delete such data from our records. If you become aware of any data we have collected from children under 16 years of age, please contact us immediately via privacy@kingliving.co.uk.
12Your consent to processing
You will be required to give Consent to certain processing activities before we can process your information. Where applicable, we will seek Consent from you when you first submit information to or through the King Living Services.
If you have previously given your Consent you may freely withdraw such Consent at any time. You can do this by emailing privacy@kingliving.co.uk or, where applicable, clicking the ‘Unsubscribe’ button that appears in mailing list communications.
If you withdraw your Consent, and if we do not have another legal basis for processing your information, then we will stop processing your information. If we do have another legal basis, we may continue to do so subject to your legal rights.
Please note that if we need to process your information for you to use the King Living Services and you object or do not provide Consent, you accept that the King Living Services will no longer be available to you.
13Marketing and opting out
If you have given Consent to marketing we may contact you about our products, services, promotions and special offers. If you no longer wish to receive such information, you can withdraw your Consent at any time by sending an email to privacy@kingliving.co.uk or unsubscribing from the communications.
If you have given Consent, we may share your information with carefully selected third party organisations and business partners and they may contact you directly. If you would prefer to no longer receive direct marketing communications from third parties and partners after previously giving your Consent, please contact those third parties and partners directly to withdraw the Consent.
14Account information
You may at any time review or change the information in your account by logging into your King Living account.
If you wish to terminate your King Living account, please contact us via privacy@kingliving.co.uk and we can arrange this for you. Some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our Terms and Conditions and/or comply with legal requirements.
15What are your privacy rights?
You have certain rights in relation to the information that we hold about you depending on where you are located or from. For EU and UK citizens and residents you have a number of specific rights, details of which are set out below. If you are based in another country and request to exercise one of the rights below or any other right you may have, we will do our best to fulfil such a request and will always fulfil the request if legally required. Please note that we will require evidence of your identity before we are able to respond to any requests — this is a security measure to ensure that your information is not disclosed to a person who does not have the right to receive it. We may also contact you to ask for further information in relation to your request to speed up our response. To exercise or discuss any of your rights, please contact us via privacy@kingliving.co.uk.
- Right of Access. You have the right at any time to ask us for a copy of the information that we hold about you and to check that we are lawfully processing it. Where we have good reason, and where data protection law permits, we can refuse your request for a copy of your information, or certain elements of it, and will provide our reason(s) for doing so.
- Right of Correction or Completion. If information we hold about you is not accurate or is out of date and requires amendment or correction, you have a right to have the data rectified or completed.
- Right of Erasure. In certain circumstances, you have the right to request that the information we hold about you is erased (for example, if it is no longer necessary for the purposes for which it was collected or processed, or our processing is based only on your Consent and there are no other legal grounds to process it).
- Right to Object to or Restrict Processing. In certain circumstances, you have the right to object to our processing of your information (for example, if we are processing it on the basis of legitimate interests but there are no longer compelling legitimate grounds that override your rights and interests).
